Terms of Use

Version 1.0

1. The licence

the Software Provider ("Provider") grants test clinic ("Hospital") a non-exclusive, non-transferable licence to use this software for the Hospital's own clinical and administrative work, for the period and number of users stated in the Hospital's licence key and agreement.

The software remains the property of the Provider. The Hospital may not copy it, sell, rent or sub-license it, give it to another organisation, reverse-engineer it, or remove or bypass the licence check.

2. Hospital data

All patient and hospital data entered into the software belongs to the Hospital. The Provider does not own it and will not use it for any purpose other than providing support the Hospital asks for.

The Hospital can export all of its data at any time from Settings > Data Export, and is responsible for keeping its own backups in addition to the nightly backup the installation makes.

3. Clinical decision support is only an aid

Features such as allergy warnings, vaccination schedules, dosage and quantity calculation, follow-up reminders and templates are aids for the treating doctor. They may be incomplete or wrong. The software does not give medical advice or make diagnoses; every clinical decision remains the responsibility of the doctor.

4. Hospital responsibilities

The Hospital will keep user passwords confidential, give each staff member their own login with the correct role, remove access for people who leave, keep its server, network and devices secure, and use the software in line with the law, including medical-records and data-protection rules.

The Hospital is responsible for the accuracy of what its staff enter, and for obtaining any consent required from patients.

5. Support and updates

Support and updates are provided as described in the Hospital's agreement. The Provider may release updates to fix problems and improve the software. Updates should be installed using the update tool supplied with the software so that data is backed up first.

6. Availability and limits of liability

The software is provided "as is". The Provider does not promise it will be uninterrupted or error-free. To the extent the law allows, the Provider is not liable for indirect or consequential loss, loss of profit, or loss of data that could have been avoided by keeping backups, and its total liability for any claim is limited to the fees the Hospital paid for the licence in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law.

7. Ending the licence

The licence ends when it expires and is not renewed, or if the Hospital breaks these terms or does not pay. After the grace period the software stops allowing sign-in; the Hospital's data stays in its database and can still be exported or restored by the Hospital with the Provider's help.

8. General

These terms, with the Hospital's licence agreement, are the whole understanding between the Hospital and the Provider about the software. Indian law applies. If any part is found unenforceable, the rest continues.

Questions: contact the Provider named in your agreement.
